King
DANIEL M DAUGHERTY
and his
Court Jester,
FRED E BAXTER
have made it
VERY EXPENSIVE
($13,485,540.00)

to poop in
wEST vIEW,
starting in 2007
and continuing
for the next
THIRTY YEARS!

THE SUPREME COURT OF PENNSYLVANIA
HAS SPOKEN, LOUD AND CLEAR

After numerous appeals, Fred Baxter
has lost a lawsuit which will cost residents of
wEST vIEW, 13.5 MILLION DOLLARS*

Pay now.....
or pay MORE

later.
the "MORE"  is
"ONLY" 450%
of 3 MILLION,
or...
$
13,485,540
GOOD GRIEF!

"The Waste Water Department has been sued by the Girty's Run Joint Sewer Authority in a dispute over the Authority's responsibility for improvement. The amount of any potential judgement cannot be estimated at the present time, but it would likely be financed by a bond issue and the rates charged to users could be affected."

The above is quoted from December 31, 1999 as printed
in the Municipal Authority of West View's annual report,
where Daniel M. Daugherty is the director.

PRECISELY HOW MUCH WILL THIS
COST THE RESIDENTS OF wEST vIEW?

Under the leadership of Daniel M Daugherty, large sums of money have already been paid to Borough Solicitor Fred Baxter, Pittsburgh Attorney as well as other consultants, during the course of this lawsuit. Instead of paying for a 3 million dollar bond ten years ago, repaying 13,485,540 million dollars will now be the full responsibility of the residents of wEST vIEW.

In an effort to minimize the financial ramifications,
wEST vIEW officials have characterized it as...
"It was a case of pay now or pay later."

Actually, it's...
PAY NOW OR PAY MORE THAN FOUR TIMES AS MUCH LATER!

The residents will be paying later ....
right through their noses, and for a long time to come.

What can only be described as BAD LEGAL ADVICE, will now cost
residents more than FOUR TIMES the amount originally due!

There will be a jump in charges of almost
THREE HUNDRED PERCENT
for wEST vIEW residents' Waste Water bills,
for the next THIRTY YEARS!

HOW THIS AGREEMENT HAS BECOME SO COSTLY
FOR THE RESIDENTS OF wEST vIEW

A

Refusal of wEST vIEW Water Authority to pay 3 million dollars to honor their contract with Girty's Run Joint Sewer Authority. The current judgement of $7,226,982.24 is the result of a lawsuit filed on September 11, 1996.

B

The heavy handed leadership of Daniel M. Daugherty.
(Director wEst vIEW Water Authority and President of wEST vIEW Council)

C

The self-serving actions of Fred E. Baxter, Pittsburgh Attorney, coupled with his thoroughly inept legal advice.
(Attorney wEST vIEW Water Authority and Solicitor wEST vIEW Borough)

D

Ten years of Attorneys' fees TIMES TWO, since attorneys from both sides are to be paid as per order of court!

E

Ten years of court costs and appeals, in courtrooms all the way to the Supreme Court of Pennsylvania.

F

Ten years of interest on millions of dollars.

G

Incapable personnel who have been appointed or elected to fill key positions. They can be collectively described as "yes-men", and have been a total disservice to their community.

H

Uninformed residents who are adverse to, or unaware of, the checks and balances that an alternative political party can provide.

I

Ignorance or indifference of the electorate to the conflicts of interest and the nepotism, which have been created by the inappropriate marriage of wEST vIEW Borough and wEST vIEW Water Authority.

J

All costs related to floating a $7,695,000 bond, resulting in the total cost of $13,485,540. To be paid for by water users in the Borough of wEST vIEW until the year 2037.

Supreme Court of Pennsylvania Denial,
Dated Sept. 15, 2006

Fred E. Baxter, Pittsburgh Attorney
would have surely won if the case was heard by the friendly
wEST vIEW Zoning Board Tribunal
where his former law partner, Dennis A Watson is the chairman.
But removed from the Borough of wEST vIEW, Pa. courtrooms,
Fred Baxter appears to be rendered impotent.

But before you shed any tears for poor old Fred Baxter, consider the fact that he was paid tons of money during the many years he agressively and relentlessly pursued this lawsuit.

....documented in the minutes from the
Borough of West View Council meeting of October 11, 2006

"Mr. Barr from 200 Frankfort Avenue asked Council if there was an update on the Girty's Run Litigation.

President Daugherty said he had not heard anything yet."

....as the wEST vIEW Borough Solicitor, and Pittsburgh Attorney, Fred E. Baxter sat mute

Interesting to note....

The First Pony Express Run began in St. Joseph, Missouri on April 3, 1860 The run's destination was Sacramento, California, a distance of about 1700 miles that was covered in a little less than eleven days.

More than 146 years later, on September 15, 2006--a court order from the Pennsylvania Supreme Court, Western District, took close to two months before reaching West View.

By far, this is the most financially horrific blunder ever perpetrated upon
the good (but uninformed) citizens of wEST vIEW Borough, since it was founded in 1905!

*Not honoring a contract with Girty's Run for $3,000,000 from 1996, has resulted in a whopping settlement when court costs, attorney fees and interest were added.
Thirteen million four hundred and eighty-five thousand, five hundred forty dollars
will be the total cost residents will repay over 30 long years.

$7,226,982 BIG ONES

The is THE most requested script I have had. The Watermark received wide acclaim when it landed on Geocities, the largest homepage provider in the world. Since then, people have been trying to make their own Watermark, but to no avail. Finally, Nic's Javascript Page has come up with a small, customizable code for the watermark that is cross browsered. If you don't know what the watermark is, look at the image to your lower-right. It stays in place even as you scroll. This is great for advertising your page or others.
The source..

<DIV CLASS="jsbrand" ID="jsbrand" STYLE="position:absolute;top:1;visibility:hide;" zIndex="1000" ALIGN="right">
< TARGET="_top"><IMG SRC="jsnow.gif" ALT="$7,226,982 BIG ONES" BORDER="0"></A> </DIV> <script language="Javascript1.2"> <!-- // you must keep the following lines on when you use this // original idea from the Geocities Watermark // © Nicolas - http://www.javascript-page.com var window_says = "$7,226,982 BIG ONES"; var image_width = 88; var image_height = 31; var left_from_corner = 0; var up_from_corner = 0; var JH = 0; var JW = 0; var JX = 0; var JY = 0; var left = image_width + left_from_corner + 17; var up = image_height + up_from_corner + 15; if(navigator.appName == "Netscape") { var wm = document.jsbrand; } if (navigator.appVersion.indexOf("MSIE") != -1){ var wm = document.all.jsbrand; } wm.onmouseover = msover wm.onmouseout = msout function watermark() { if(navigator.appName == "Netscape") { JH = window.innerHeight JW = window.innerWidth JX = window.pageXOffset JY = window.pageYOffset wm.visibility = "hide" wm.top = (JH+JY-up) wm.left = (JW+JX-left) wm.visibility= "show" } if (navigator.appVersion.indexOf("MSIE") != -1){ if (navigator.appVersion.indexOf("Mac") == -1){ wm.style.display = "none"; JH = document.body.clientHeight; JW = document.body.clientWidth; JX = document.body.scrollLeft; JY = document.body.scrollTop; wm.style.top = (JH+JY-up); wm.style.left =(JW+JX-left); wm.style.display = ""; } } } function msover(){ window.status = window_says return true; } function msout(){ window.status = "" return true; } setInterval("watermark()",100); //--> </script>

Color coding..

This is the image, text, whatever that you want to put in the watermark.
This is what you want the window statusbar to say when the user goes over the watermark.
This is the width and height of the image, text, whatever that you have in the watermark. As you can guess, having an image works best with the watermark.
This is the amount left of the scrollbars that you want the image to be.
This is the amount up of the scrollbars that you want the image to be. If you are a Geocities citizen and have the geocities watermark implanted on your free page, use the number 41 for this variable so the two watermarks won't conflict.
